Canadian Poker Site Faces Class Action Lawsuit Over Exposed Hole Cards

Loto-Quebec’s provincially run online poker platform, EspaceJeux, is facing a class action lawsuit after allegations of a major software glitch that exposed players’ hole cards to certain users, potentially giving them an unfair advantage.

The Allegations

The lawsuit, filed by poker player Elizabeth Bertucci in Quebec, claims that a serious defect in the platform’s software was present until May 18, 2020. According to the legal complaint, players using iPads or possibly any other iOS devices could see the hole cards of other players after the hand had concluded, regardless of whether or not those players had mucked their cards.

Bertucci argues that this glitch created an unfair playing field, as players using non-iOS devices could not access the hole cards and were thus at a significant disadvantage. The lawsuit further alleges that Loto-Quebec, the agency responsible for EspaceJeux, failed to inform players of the flaw and did not take action to address it in a timely manner.

Failure to Act

The class action suit asserts that Loto-Quebec did not provide a “secure platform that respects the integrity and rules” of the game. It also claims the provincial agency deceived its player community by not implementing measures to prevent the misuse of the exposed hand histories, such as changing usernames to stop others from analyzing them.

The lawsuit draws parallels to a similar breach on a competing offshore poker site, where software providers changed usernames for all players to ensure fair play. Bertucci’s legal team contends that Loto-Quebec should have taken similar steps to maintain the integrity of the game.

Previous Controversies

This isn’t the first time Loto-Quebec has found itself embroiled in controversy over its monopoly on online gaming in the province. In 2018, the Quebec government sought to force Internet Service Providers (ISPs) to block access to offshore poker sites and casinos to ensure more revenue flowed to EspaceJeux. However, the Super Court of Quebec ruled the proposed legislation unconstitutional, effectively preserving access to international gambling platforms.
