In response to the escalating COVID-19 pandemic, Spain has introduced one of the toughest gambling advertising laws in the EU, effectively banning most forms of online gambling promotion — including poker — during the public health emergency. The new regulation, signed into law through a Royal Decree, restricts gambling ads to a narrow window between 1:00 AM and 5:00 AM, and prohibits operators from using pandemic-related messaging or offering sign-up bonuses and incentives.
Described by insiders as a “de facto gambling ad ban,” the legislation aims to prevent companies from exploiting stay-at-home restrictions and vulnerable consumers during lockdowns. Spain’s Minister of Consumer Affairs, Alberto Garzón, emphasized the urgency of these consumer protection measures, noting that 80% of existing ads are now deemed illegal.
Gambling sites are now required to remove all advertising content targeting Spanish users — including banners, promotional content, emails, and even social media posts. Non-compliance could lead to severe penalties under Spain’s Gambling Act.
